CBD Bakes Limited is a limited company incorporated in England & Wales with Registered Number 11707245 and whose registered office is CBD Bakes Ltd, Derbyshire, DE128DA.

The following constitutes a legal agreement between a visitor (you) and us with respect to our website.
You must be at least 16 years of age to agree to and enter into this agreement on your own behalf and to register for use of this site.
When registering on our site or purchasing a product, by checking the box indicating your acceptance of this agreement, you represent (i) you have read, understood and agree to be bound by this agreement and (ii) you are at least 16 years old with your own registered bank account from which your purchases can be made from.
Our site has been established to enable you to choose and purchase a range of products from our exclusive collection; quickly & conveniently from our online shop. It also allows you to access all the relative information about our products & our company.
ACCESSING OUR SITE:
We have made every effort to display as accurately as possible that the colours on the screen are as close as to the colours of the actual product. However the colour of the actual product as you see on your screen will depend on your monitor, screen settings & resolution. Accordingly we cannot guarantee that your monitors display of any colour will accurately reflect the colour of the product on delivery and we cannot accept the return of any product because it does not match the colour you were expecting.
Variations in computers, browser and operations will create differences in visual layout and usability of the site. We have done all we can to minimise this but we cannot be held responsible for specific operational differences.
We reserve the right to at any time or from time to time to modify or discontinue, temporarily or permanently the site (or any part thereof) without notice to you and without any liability to you or any third party.
We welcome “hot links” to the site, but not “deep linking” by which we mean that you may not include a link to our site, or display.
TERMS & CONDITIONS FOR PURCHASING OF PRODUCTS.
Our website services permit you to purchase our products from this site. These purchases can be made and are permitted strictly in agreement to the terms and conditions set out below:
Your order constitutes an offer to us to buy a product. After placing an order you will receive and an email order receipt. This is to let you know we have received your order. This is an auto generated response. You will then receive a receipt for the order payment. Once your payment has gone through your order will be moved to the processing stage. We will then send you a processing email which will confirm your order details, any extra charges, and an expected postage or delivery date. At the point you receive your order processing email, no refunds can be issued. This is because we only bake to order and once an order has been processed, a lot of work has already begun. If you contact us before you receive your processing email we will endeavour to refund the full amount.
If you wish to cancel your order for any reason you must notify us within 24 hours by email or phone. If your order hasn’t been processed we will endeavour to give you a full refund. However if your order has been passed to the processing stage, a refund is not possible as work will have already begun on your order.
If you wish to change your order in anyway please contact us by email or phone within 24hrs of placing the order and we will endeavour to make the relevant changes where ever possible. If you want to make changes to your order but your order is already in the processing stage, then change may not be possible. However we will wherever possible do all we can to change your order but this cannot be guaranteed.
The website states a blanket price for postage. However depending on your order items and size, delivery may cost more. You will be advised of any extra delivery cost in your processing email. If you are required to pay more than the blanket cost shown on the order form, you will receive an invoice from us for the remaining amount. Once this has been paid in full your orders processing stage will be complete and you will be advised of your orders expected delivery date.
Prices on our website are liable to change at any time, but changes will not affect any orders that have received a processing conformation email.
In the event of our stock items being priced in correctly on our website, despite our best efforts to rectify this, we will normally confirm prices in the order processing email. But if a products correct price is less than our stated price, we will charge you the lower amount and we will credit your account with the difference. If a products correct price is higher than the price stated on our website, or we are no longer able to provide you with a particular product for whatever reason, we will contact you by email or phone to obtain your confirmation that the amended price is acceptable before passing your order to the processing stage.
All payments for all products must be made by a credit or debit card. The types we accepted are displayed on the bottom of each page of the website. All payments must be made via the website on the date you place your order. We will send you an order receipt via email upon receipt of your payment.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuers. If the issuer of your payment card refuses or for any reason does not authorise payment to us, we will not be liable for any delay or non-delivery of the products ordered.
MADE TO ORDER, AVAILABILITY, POSSIBLE POST & DELIVERY:
We freshly bake to order. We are a small Bespoke manufacturer of freshly baked raw hemp infused products. All our products are handmade exclusively for your order and dispatched to you in the quickest time possible. This time length can depend on many aspects but we will confirm delivery date in the order processing email that we send to you. If we are particularly busy there is a chance your delivery date will take longer. If you know in advance that you would like an order of products for a certain date, place your order straight away to avoid disappointment.
The products ordered by you can only be delivered to the address provided by you on your order form. This address will be used to calculate your postage / delivery costs. We advise that it is best, if you have ordered fresh baked goods, to arrange for someone to be present at the address provided, to take receipt of your delivery on the date stated. If there is no one to take receipt of your products they will be returned to the depot, unless you have stated otherwise. At this point we can no longer take responsibility for your goods or the condition that you may later receive them in. We can only guarantee the freshness and the condition of our products if they are received correctly on the delivery date stated.
If you notice an error in the order receipt email you must notify us straight away by phone or by email. If we have not yet begun to process your order and you haven’t received your order processing email we will do all we can to correct the error.
If you wish to cancel your order for any reason, you must notify us within 24hrs of placing your order. If you haven’t received an order processing email from us we will do our best to refund the total amount. However if you have received an order processing email, then we are unable to issue a refund as work will have already begun on your order.
All goods, postage & delivery costs must be made in full, along with any further extra identified costs before any order can be accepted and then processed.
Our prices include VAT but exclude postage and delivery costs, which will be added to the total amount due before completion of your order can be placed.
PRICE, CHARGES, INVOICE & PAYMENTS
All our prices include VAT but exclude delivery and postage costs.
All prices are in British Pound Sterling.
All goods, delivery and postage costs must be paid in full by you before your order can be accepted and passed for processing.
Our website states a blanket cost price for packaging & delivery. This standard cost is £5. If your order is bigger or more complex to deliver, the charges maybe more. You will be advised of any extra charges in your order processing email. If you are required to pay more than the standard £5 charge we will include an invoice for the remaining amount. This will need to be paid in full before your order can be processed. Any delay in settling the remaining amount will subsequently delay your orders completion & its delivery date. Once your remaining charges have been paid in full you will receive an email receipt as well as order processing conformation with an expected delivery date.
If you live within a two mile radius (reference map and postcode on website) delivery is free and packaging is charged at £2.00
CBD Bakes products, postage & delivery prices are liable to change at any time but this will not affect orders that have already received their Order Processing Confirmation Email.
Our site contains a fair amount of products and it is possible that despite our best efforts some products may at some point be shown at an incorrect price. If this was to ever happen we would charge you the lower price or refund the difference. If the products correct price is higher than the price shown we will contact you to advise and obtain your confirmation that the amended price is acceptable.
All payments for all products must be by credit or debit card, MasterCard or Visa, on the date when your order is placed. We will send you a receipt on conformation of your payment being processed.
All credit/debit cards are subject to validation and security checks and authorisation from the card issuer. If the issuer of your payment card refuses or for any reason does not authorise payment to us whether in advance of or subsequent to a payment, we will not be liable for any delay or non-delivery or receipt of any products ordered.
Deliveries to these areas may occur extra costs: NORTHERN IRELAND, OFFSHORE ISLES, CHANNEL ISLANDS, SCOTLAND POSTCODES & timescales may also be different for these areas.
If for any reason you should feel unhappy or dissatisfied with your product upon receipt of it please photograph what it is that is an issue immediately and send them with details to firstname.lastname@example.org
If the issue is as a result of our mistake we will endeavour to reimburse you immediately. If the issue is a result of postage & delivery you will need to take photos immediately and send them to us, with details to email@example.com You will need to retain the damaged goods and the packaging so that we can make a claim against the courier and look to reimburse you. If however you haven’t been available to take receipt of your package and its been returned to the depot we are unable to take any responsibility for its condition and we are unable to make a claim against the courier.
We can only make a refund to the original credit card or debit card used to purchase the products.
We cannot accept any returned goods that haven’t been purchased directly from our website.
We cannot refund any purchase simple because it is stated that you do not like the taste of the product. Obviously taste is a very individual matter and once our products have been opened and tasted, no refund can be offered. We offer products in 3 different strengths to try and cater for a range of tastes but a refund cannot be made just because you do not like the products taste.
OUR RIGHT TO CHANGE OUR TERMS & CONDITIONS
We have the right to change and amend these Terms & Conditions from time to time, for any reason that we feel is relevant and required to ensure the safety of our products, our customers, our company and our website.
If we make changes or amendments to our terms & conditions and you are on our mailing list you will be made aware via email or it will be your responsibility to check the site to see if there has been an update replacement to our terms & conditions. All changes will be made and then the website will be updated with these changes before they are put into place.
It is your responsibility to make sure all the details you provide to us ie your personal data, is accurate and correct. We will only use your personal data in line with Data Protection Act 2018.
It is your responsibility to check your order details as well as your payments details before submitting your order.
It is your responsibility to make sure that if you are on our mailing list that to receive up to date information and offers
You agree to indemnity with in these terms & conditions and therefore hold our director, company and any employee from any claim, losses of causes of action arising from or concerning any breach by you of this agreement and our terms & conditions for your use of the site and you agree to reimburse us on demand for any losses, costs or expenses we incur as a result thereafter.
THE MISUSE OF OUR WEBSITE
You will not attempt or encourage others to attempt to copy or make use of any material that appears on our website. Anyone found doing this would be judged as an infringement of our copyright.
We reserve the right to block your access to our site if you are found to be accessing it other than for its proper purpose.
We reserve all rights to all material and intellectual property content on this website, without limitation; trademark, icon buttons, logos, graphics and images are all owned by CBD Bakes Ltd and are protected by International Copyright Laws. We will have the right to take legal action against anyone found constituting an infringement of our copyright.
RECALL & WITHDRAWAL POLICY
There may be a very rare occasion when one of our suppliers may make us aware of an issue or safety problem with one of their products that they supply to us at CBD Bakes. Obviously the safety of our customers is paramount so the product would be removed from our supply immediately. If this was to happen we have strict safety rules in place which mean we are easily able to identify the product, which batch it is from, its location, and which of our CBD Bakes products that it may affect, as well as customers that may have received these.
We have clear procedures in place to make sure our products and our customers stay as safe as possible. In a situation like this we will always issue a product withdrawal and recall immediately on our website, on our online shop, and on our social media accounts, Facebook and Twitter. Along with this notice and recall we would also issue help and support advice information with regard to the affected products and what you should do. We would also, wherever possible, try to contact directly any customers identified as affected through email.
If at any time you become aware of any safety problem or issue regarding any of our ingredients please contact us immediately.
We always make sure all our ingredients for each and every product we sell are easily available on our website for our customers to access at anytime. Along with these ingredients we also very clearly state all known allergens in any of our products. If in the unlikely situation we were made aware that there was an allergen present in one of our products but not labelled or stated, we would immediately issue a product withdrawal and recall, issue the notice on our website, online shop, our social media pages and wherever possible we would notify customers in receipt of these products directly by email. This product would not return to our menu until all safety checks had been completed.
